The most important trend in my opinion is the change to attorney-client privilege. In essence it allows for the privilege to be lifted from the clients themselves to third parties not involved in the legal relationship. The clients now have the right to go into a third party’s business without giving up their own right to privacy. A few years ago the client was held captive and could not go into the business.

A few years ago the client was held captive and could not go into the business.I believe this change is the result of new legislation being passed in a few states. Basically, this allows for the client to bring in a third party as a witness and their attorney will not be able to withhold this information. It is also possible that the attorney can make a good-faith argument that it is privileged and therefore not discoverable.
